Weight of evidence is the believability or persuasiveness of evidence in probative value, not the quantity or amount of evidence. Weight of evidence is not determined by mathematics, but depends on its effect in inducing belief. In State v. Thomas, 50 NE 3d 967, it was determined that the weight of evidence has to do with the tendency of the credible evidence in a trial to support one side over the other.
