strip search

Primary tabs

A strip search is an inspection of a naked person. Strip searches are generally improper unless supported by probable cause. When determining the reasonableness and legitimacy of a strip search, the court will consider the totality of circumstances to see whether a strip search is necessary to reveal evidence otherwise unobtainable to justify the intrusion of personal rights. Factors like the scope of the search, the place and the manner in which the search was conducted are generally taken into account.
