Canadian Anti-Spam Law of 2010: Effective Date

On April 1, 2011, several amendments to the Personal Information Protection and Electronic Documents Act ("PIPEDA") made by the Canadian Anti-Spam Law of 2010 went into effect. Pursuant to Clause 91 of the Canadian Anti-Spam Law of 2010, most of the remaining provisions of the Law came into effect in 2014, as determined by the "Governor in Council" (the Governor General, on the advice of the Canadian federal Cabinet):

  • Sections 1 to 7, 9 to 46, 52 to 54, 56 to 67, 69 to 82 and subsections 12(2) and 12.2(2) came into effect on July 1, 2014.
  • Sections 47 to 51 and 55 will come into effect on July 1, 2017.
