Under the Chairmanship of Senator John McCain, the United States Senate Committee on Commerce, Science, and Transportation issued a Report dated July 16, 2003 (the "Senate Commerce Committee Report") to accompany S. 877, the Bill that was ultimately enacted as the CAN-SPAM Act of 2003. This Senate Commerce Committee Report provides a comprehensive overview of the CAN-SPAM Act, as well as a statement of the policy issues and goals driving its enactment. See S. Rep. No. 108-102 (2003). It has been cited by courts drawing on legislative history and Congressional intent to interpret the CAN-SPAM Act. See, e.g., Gordon v. Virtumundo, 575 F.3d 1040, 1049 (9th Cir. 2009).
