Commercial Email and Spam:

In 1999, the State of Delaware enacted a law (1999 Delaware Laws Chapter 135 (H.B. 242)) making it a misdemeanor to send spam emails ("unrequested or unauthorized electronic mail"), and to ignore requests to "opt out" of spam emails ("failure to promptly cease electronic communication upon request"). See Delaware Code Annotated Title 11, Chapter 5, Subchapter III, Subpart K (§§ 931, 937-939, 941).

Telemarketing & Telephonic Anti-Solicitation:

Delaware Telemarketing Fraud Act: Delaware Code Annotated Title 6, Chapter 25A (§§ 2501A - 2509A).

Unlawful Trade Practices:

The twin foundations for consumer protection in Delaware are found in the Consumer Fraud Act - Delaware Code Annotated Title 6, Subtitle II, Chapter 25, Subchapter II (§§ 2511 - 2527) - and the Uniform Deceptive Trade Practices Act - Delaware Code Annotated Title 6, Subtitle II, Chapter 25, Subchapter III (§§ 2531 - 2536).

Delaware has also enacted penalties for certain deceptive trade practices - see Delaware Code Annotated Title 11, Part I, Chapter 5, Subchapter III, Subpart 1 (§ 906) - and a prohibition against deceptive practices in consumer contracts - see Delaware Code Annotated Title 6, Subtitle II, Chapter 27, Subchapter IV (§§ 2731 - 2736).

However, none of these statutes applies specifically to commercial email and spam.

Pornography:

Email transmission of child pornography constitutes a felony under Delaware Law - see Delaware Code Annotated, Title 11, Part I, Chapter 5, Subchapter V, Subpart A (§§ 1108 - 1111).

Computer-Related Crime:

Email communications may constitute the basis for "Sexual solicitation of a child," a Class C Felony under Delaware law - see Delaware Code Annotated Title 11, Part I, Chapter 5, Subchapter V, Subpart A (§ 1112A).
